I've completed the BK process this year and I received a discharge about 6 months ago.
I've got an auto loan that I never had to reaffirm because I've always made my payments on time. My credit report indicates a loan balance of zero and 'included in bk' is in the notes section. I really don't want this car anymore and I would love to get rid of it. Can I safely walk away from this loan and not be responsible for it? I talked to an attorney and he said the longer you wait to get rid of the car the harder it becomes. He also stated that since you've been making your payments over the last several months it's like reaffirming w/out signing the papers. Is this true?
Secondly: This auto loan was included in my bk as a necessary expense. Wouldn't the bank make an issue out of this since I listed the auto as a necessary expense, therefore, I should be making the payments?
