What is the name of your state (only U.S. law)? Texas

I am trying to understand something. Someone I know got their second DUI in 7 years in Bexar County and refused a breathelizer. His liscence was then taken by the police. His ALR hearing is in another week but he now has his liscene back. Can anyone explain to me how this works? I thought he had to wait till AFTER the ALR hearing to get his liscence. Thanks.
