is a translator for Mom necessary?

Yes.

You may be "involved" in the case but if you aren't a party to the case (plaintiff or defendant) the other party has a right to put your mother on the witness stand, question her, and insist that she answer without your help.

That's why she needs an unbiased court-appointed translator.

She could lose the case if she is not willing and able to speak for herself.

Hi we were given new date for countersuit..I requested By The Court... I am my Mom s power of attorney. I was told I can speak on her behalf.. Her English is poor and I am involved in the case 99 percent...the office clerk informed when we go back in January to say Application...for request of translator and I want to amend monetary amount. Even though I will still speak on behalf of Mom is a translator for Mom necessary? She is the Landlord but I am involved with much if of... Documents etc..

You CANNOT "speak on her behalf". You are a WITNESS. If I were the other party, I would request that you not be allowed to be a translator - she needs to ask that one be assigned (as was pointed out above.)

New York's Office of Language Access assists those with limited English proficiency by providing interpreters free of charge. The interpreter will translate for your mother.

Here is a link to information on getting a court interpreter lined up for your mother:

First off I did not request to be her translator. Read carefully.

You will want to inform the court clerk of your mother's need for an interpreter. You do not want to be responsible for any misunderstanding your mother might have of the court proceeding.

There are contact numbers in the links I provided so you can better understand the need for an interpreter who is not part of the legal action.

Good luck.

Okay. You really need to say more than "application." You will need to say "interpreter," too.

Good luck.

Again, you are NOT a "party" to the case...you are a witness.
