Currently my boyfriends Childrens mother is fighting for full custody. He took her to court in 2001 to file for joint, he got it and his monthly payments were also reduced. NOW, she wants full custody on the basis that: (All Untrue) Him and I engage in sexual activity while she is downstairs watching a movie and his daughter can hear us. We sleep on the bed and make his daughter sleep on the floor.
She had also reported that we were having intercourse in front of his daughter to child services about 7 months ago. They investigated and interviewed both him and his 6 year old daughter and the case was declared unfounded. Would this be evidence enough to prove her statements false at the custody hearing?
In her statement when she filed for joint custody she had to "Exhibits."One was a calender stating that she had their daughter more days than he did. In her calendar she stated she had their daughter on Easter. He has a police report saying that he had to call the police because she was not allowing him his court appointed time. So he had her on Easter. Would this police report prove her "calendar" wrong? And shoot her credibility for the entire calendar?
One more thing.....her other Exhibit was a credit report with both his name and her name on it. She included in her statement that she felt betrayed and was very upset at the fact that they were supposed to move in with one another and then he pops up with a girlfriend. From the time the credit report was ran to the actual time I was with him was a difference of about 7 months, so before anyone slaps the homewrecker title on my forehead, no I dont feel like a homewrecker. Question: Arent her emotions irrevelant? What does it matter that she felt betrayed? Could this possibly be used against her?
Final question: does anyone know that odds that she will win this case?
