Hello,

I'm engaged to a French citizen. We have a pending i129f (fiancé visa) that we are waiting on. It's a normal situation in terms of no red flags and should be passed (we imagine). Since it can take so long she wants to stay here, in the US on a b2 (we'll probably apply to extend her stay to a year if need be). My apartment lease expires in March next year and she might be looking to move here around January.

Are there any potential problems with my landlord about not allowing her to stay in my apartment with me?

How on Earth would anyone here know if your LL would have a problem with your fiance staying with you? Call and ask your landlord.

Your non-legal question baffles me. You need to ask your LL if s/he has "a potential problem" with your girlfriend staying with you. The members of this site have no way of knowing if LL would care if you have an extended stay guest.

Of course you could clarify your question if that is not what you really meant to ask.

that there needs to be preapproval for any additional residents in a unit. I was looking to get info on a legal forum before talking to them. I had no idea what to expect and wanted to prepare for the conversation. It seems like it's just up to them? They can say yes or no depending on their mood/personality?

Does my state not matter on this topic? I thought there would be laws relating to this situation.

The answer is in your contract. It is perfectly legal for your ll to require any additional residents to be approved before moving in. It is perfectly legal for the ll to say "No." to any additional residents. It is perfectly legal for the ll to say "No." because they are in a contrary mood.

If she moves here before the fiance visa is approved you are going to have problems getting her permanent residence approved. She is supposed to enter the country on the fiance visa. She can visit and go back home prior to that, but she must enter the country on the fiance visa, and must not be here when it gets approved. Consult an immigration attorney for further details. You do NOT want to mess that part up. You must also get married within 90 days of the visa being approved.
