My new manager recently wrote me up for a myriad of issues, and most of them were REALLY, REALLY nitpicking-type stuff. In one case he said I failed to complete a project when in fact I did complete the project (albeit not quite properly) and he took over and finished it. However, 2 days later he went on vacation and failed to complete the same project which I took over and finished for him.

In another instance in the same write-up he flat-out lied, and after a few discussions with my HR department they forced him to change what he wrote.

A week earlier he introduced his new "hire", a 20-something looks-like-she-just-fell-out-of-a-Victoria's-Secret-catalogue woman. A fellow co-worker who had worked previously with this manager remarked, "She looks just like everyone he's ever hired".

I'm a 40-ish balding guy with a beer belly, and I have a feeling I'm not his ideal "employee".

I initially told my manager's manager that I felt harassed and that I couldn't work with someone like him because he's in charge of my performance reviews. I was told that "employment is a free state" and if I didn't like it I could quit. Am I facing a type of discrimination, and do I have any recourse if I lose my job? Considering he lied on my write-up and was forced to change it I would hope I have a leg to stand on.

If you believe you are being treated less favorably because of your age and/or gender, then the first step is to notify human resources of that so they can investigate. If, after that, you feel the discrimination is continuing, then you may file a complaint with your State's equal rights division or the federal EEOC.
