Came to US Jan 2001,
Worked without INS authorization due to life/financial hardship
Graduate with Bachelor in science Dec 2004
Married to a US-Citizen winter 2005,
Applied for AOS June 2005
Appointment for finger prints September 2005
Applied for Work EAD July 2005, never received the EAD Card
Instead I Got DUI fall of 2005 (the officer found me replacing my flat tire on the roadside and asked me for chemical test I refused, blood warrant showed alcohol, my license got suspended. I appealed for the chemical test refusal, in two weeks while attending DUI court/case, I received interview letter for FEB 2006, while still working illegally since I never got my EAD card, and my wife lost her job two month before interview. I was placed on a 12 month reporting Probation 30 hours community service and $1200 fine. The good thing, the officer withdraw the chemical test refusal and was granted a restricted driving license.
The interview day approached I completely loosed hope no enough affidavit support, working illegally, 12 month reporting probation, didn't receive My EAD card, expired passport...but I went there with one Goal "to tell the truth no matter What"

On Feb I went to the interview. :D

Not a good sign that you have a DUI now. Do you have an attorney? If not, get an attorney to analyze your case and to show to the USCIS at the time of the interview why you are not inadmissible for permanent residence.

I Got It

Thanks Lana,
I got my Greencard, the officer was super nice, in fact, he went through my school transcripts which were attached on my case report as a proof to the judge that I am not a fool alcoholic, and asked me how in hell did I get DUI, I told him the situation, and he said to be careful and have a lawyer when applying for citizenship.
