I have been the primary caretaker and psychological parent all of my five year old grandson's life. I was given informal physical custody by both parents. I allowed visitation by both parents at all times. Five days ago I allowed overnight visitation to parent in another county. Three days ago when I tried to pick up grandson a dyfs worker from that county barred me from taking grandson home. This was based on a false charge of child abuse and that the natural father wanted physical custody. This dyfs worker appears not to have performed a reasonable investigation as to the best interest of the child or fitness of placement. It appears that prior to this placement the homes were not inspected and I was not interviewed. Is there legal recourse if authority is negligent or misused to endanger the welfare of a child when it is done by the agency for child protection. Where do I go, when the local police agree with me, but say hands are tied legally.
