I live in the state of CA. In July of 1999, I went to the emergency room of the local hospital at around 4:00 am after a sleepless night with sudden and severe abdominal pain. The physician on staff that morning, gave me morphine for the pain, and then after a very breif physical exam, determined that it was most likely an ovarian cyst. I was sent upstairs for an ultra sound, which was inconclusive. After four hours in the ER, they sent me home with some valium for the pain, and I was told to get some sleep and then call my OB/GYN for an appointment the next day. When I saw my GYN, I could barely walk from the pain. She performed a few physical tests and immediately suspected appendicitis. She sent me for a blood test, and called a surgen for an appointment that day.
By the time I had surgery the following day, my appendix had fully ruptured, and probably had been for two days. The resulting infection was so severe that I became critically ill, had to have a second surgery and spent an entire month in the hospital. It took another month of recovery before I was able to take care of myself again.
Would this be considered a malpractice case? Has the statute of limitations expired?
