I am in Ohio and the legal procedings are in the state of Florida. My wife and I are legally marrier and have two children (14 & 13). We have been apart for 10 years and during that time she had a third child (4). My wife and her boyfriend, biological father of child, got into law trouble due to continued domistic issues and all three children were taken away from her and him. I have had the children since beginning of June 2009 and I have a court order giving me indefinate temporary custody. I have a court order showing I am the legal father of third child even though I am not the biological father. Some law in Florida that states that since I am married then the child is assumed mine unless someone contests, no one did, including me. Today after status hearing I now have to inform the courts through my case worker my three children and my whereabouts 24/7. On the original case the state of Florida tried to get me on abandament charges to take away my parental rights. I prove that was not the case by providing child support receipts. I was removed from case then I tried for over a year to get my kids which I finally was able to accomplish in June of 2009. My wife and I also have been working on our marriage and oddly enough this has drawn us close but Florida courts will not allow my wife to see the kids unsupervised by state worker so she cannot live with me or our children. The original case was cause by boyfriend's temper and numerous calls (8) to police and my wife failing to file a restraining order on him. All in the pass now and he signed away his parental rights to youngest. Children are 14, 13, & 4. I cannot believe when I have done nothing wrong that I have to report my children and my whereabouts to a 23 year old social worker and get told by the judge that if I do not then I will be held in non-complience. I have been doing nothing my defending my rights to be there father and I have done nothing wrong. Please any advise would help, my children want there mother back as well as I want my wife back.
