I have been working for this company for 10 years and I just received my annual vacation hous at the first of the year.I found another job alot closer to where I live and starting me out at the same hourly pay the other company was paying me so,I recently put in for my last 5 vacation days,stayed out of work for 5 days and on the fifth day in the arternoon I went in,got my things and told them I quit because I knew of others who had quit in the past and the company fired them and took all their vacation,holiday,sick pay so I decided to do it this way so I would get my vacation pay.Well,the lady in the office told me she would mail me my final check and I still haven't received it,I think they're trying to cheat me out of those vac. days.I plan on calling them this afternoon.Does anyone know what rights I have to those vac.day's pay?Please help me! thanks!

and the company fired them and took all their vacation,holiday,sick pay Some States require the payout of earned but unused vacation upon termination but Alabama is not one of them. No States require that accrued holiday and sick pay be paid out upon termination.

Since you scheduled and took the vacation before you resigned, you might be able to make the argument that these are unpaid wages that are due you. You need to contact Alabama's Department of Labor and discuss this with them.
