What is the name of your state (only U.S. law)? MA

Can the court after imposing an additional amount that is be tact on to the original payment in order to pay arrearage be included in the amount owed. For example if I am required to pay $106 a week and the additional amount that was added was $27 this would bring the total to $133. Now if I miss that payment shouldn’t only $106 of that payment be the amount that is attributed to arrears since that amount was the original order.

no. it is court order that you pay $27.00 to the arrears. so in addition to not paying the $106, you'd be in contempt for the $27. the arrear amount itself won't go up (aside from interest). but contempt is contempt.

I need you to explain further. I understand contempt is contempt but I believe I would first have to have a motion filed against me for contempt and I haven't.

let's say you owe $45k.

your current weekly ordered support is $106. you are ORDERED to pay an additional $27 a week.


now, if you chose to disregard the court order, you will owe $45,106.00 in total next week.

if you paid the court ordered amount, you would owe $44,857 in total next week.

none of those equations include interest.

Bad math Isabella.

He owes $106 per week in support.

He owes $27 towards his arrearages. If he is $45K in the hole, the next week, after paying $106 towards support and $27 to arrears, his total would be $44, 973 owed. He wouldn't take off $106 because that is owed per week.

Lets pray he DOESN'T owe $45K. Becasue at $27 per week towards arrears, that's going to be... 32.0512821 years to pay off arrears.
