I am currently developing a tribute show in which I hope to tour with or gain residency in a Las Vegas hotel/casino. I'm worried that when I present my show to another producer who could get my show into Las Vegas or somewhere else profitable, he/she may try to bribe and steal my talent to cut me out. Can I put a non-compete clause into my impersonators contract, that would stop them from performing as the artist they're impersonating in my show for 1 year after they part ways from my show/contract expires? Or maybe I can just limit it to not performing as that Artist in Vegas for 1 year. FYI-This person has never done impersonation. I will be training someone completely fresh to the impersonation world.

Well. . . . I have actually erased my own postings before, but I've done it accidentally, or through over-zealous editing, or while in the midst of a tantrum. So erasing your own postings is allowed in the sense that no one can really stop you, but it isn't at all appreciated by the forum members here and you may find that you will not get help on this forum ever ever again.

As for your question on contracts: Yes, you can pretty much put into any contract whatever you want. The trick will be in getting this impersonator fellow to agree to terms such as the ones you are proposing, first of all, and secondly, enforcing the terms of the contract if the impersonator changes his mind later. I am thinking enforcement might be difficult.

I believe that non-compete clauses are problematic in some ways in California, too, but I can't for the life of me remember why. I suppose I could check on that for you but, since I am going to advise that you consult with an attorney in your area anyway, you can get his advice. You can also benefit from the attorney's help when drafting a suitable, and enforceable, contract that can protect your show.

Thanks for the advice. One more thing. I'm thinking about trademarking the title of my show. If it's available, can I? Its a Michael and Janet jackson tribute show.

And you do have the permission of Michael and Janet Jackson, correct? If not, expect to be sued or sent a c&d immediately.

Why would I be sued? There are no domains or trademarks registered under that title.

Yes you can be sued by the Jackson family. You are wanting to make money off Michael Jackson and Janet Jackson -- their name, their music, their performance, their visage. Correct? So you can be sued. Expect a cease and desist unless you have been properly licensed.
