The two attorneys returned my calls.

Based on what I told them via phone, they both felt that even tho an Ex-Parte Motion for Emergency Temporary Custody
is usually filed by Childrens Service for removal of the children of the home, that given the information I gave them that I stood a very good chance on my own.

My question is this , as I have never needed an attorney before.I have no idea what costs are....

I got 2 different costs.
One said 2,500 to remove the kids.
The other said 1,500 retainer then as the fight when on it could be more. Lots more.

Who do I go with? I feel uncomfortable with the fact someone says they can do this for a flat fee of 2,500.

What would be reasonable for an Attorney to file an Ex-Parte Motion for Emergency Temporary Custody?

2,500 just to file the Ex-Parte motion or for the whole custody battle ? I doubt this very much..

Which one are you more comfortable with ?

Did both of them say the EP was generally only used by CS?

Yes...2,500 "flat fee" he called it JUST to file the ex-parte motion.
He also led me to believe we would win and get the kids out of that situation.

I am more comfortable with the one who told me right out, we may not win, but you do sound like you have a case.(the one who works off the retainer)

And to answer your last question.. No...only the attorney who told me we may not win said that.

All and all, after thinking on it more I do believe they are more upfront and truthful, without giving us false hope.

Legal Beagle I would be willing to pay anything if I could just find out what state to file in!!!!!
I am getting desperate.

While being bounced back and forth between two states attorney, my grandchildren may be hurt.

I thank you again for all the advice you've given me.
I was ill over the weekend,and hoping for good news from attorney in Ohio today.... thus the late reply.

Hi, it's me again. I just read your updated post on your attorney status. Go with the attorney that will work off of the retainer fee and the cost will be worth it. Try contacting the Kentucky Cabinet for family and children services in relation to the emergency order that could be filed- or try contacting the county attorney in whatever county your daughter and this man reside in (if you know it). With this situation being this serious, someone may be able to direct you to someone else who can get immediate response on this case through social services.

But the Cabinet of familes in Kentucky DONT want us to have the children : (
They stated that the goal is to reunite the family.
The boys have her and him!!!!
There daddy...and whole family is in Ohio
They know no one else there.
They even lied to me about the court date
