Auto Insurance vs. Health Insurance

What is the name of your state? PA

I was rear ended in an accident about 5 months ago. The other driver's insurance company has clearly accepted full responsibility. Unfortunately, I had a fairly low coverage for medical (Pennsylvania is no fault for medical). I am quickly approaching my limit of $10,000 and surgery appears very likely which will make me exceed the maximum amount by a great amount (they are most likely going to remove 2 discs from my neck). Question, once I reach the maximum with my medical coverage via my insurance policy, will I be able to use my health plan that I am covered thru work? How will this impact future settlement (we will be filing a claim against the other driver, etc.) If my health plan from work pays for medical costs associated with the accident, will they go after the other insurance company (subregation..sp?) or should I make sure that I include those costs in my settlement since I would pay back my health insurance company? Hope this makes sense. Thanks.

Normally, once you use up your medical payment amt. on your car ins., your health ins. coverage will kick in. If you receive a settlement later, your ins. co. will be reimbursed from your settlement.

One other quick question...we are going to be getting a PI attorney...if amount of health care costs are added to my settlement, is the PI attorney's share taken after reimbursement of health care? Thanks to all who responded.

Normally, they will take a % of total settlement. (usually 1/3) You will have you ask the PI attorney that you hire what his "procedure" is re his share.

Your health insurance will pay after your auto is exhausted, however they will probably require some documentation from your auto carrier proving that your auto coverage is used up.

Yes, you will have to pay them back out of your settlement. The attorney's fee will be taken BEFORE you pay them back. You may be able to negotiate with the attorney to have them deduct THEIR expenses (for writing letters, getting medical reports, anything else that they incur in the course of your case) before taking their percentact, but the money you will owe your health insurance carrier has nothing to do with them, it will be up to you to make sure there is enough to pay them back and still have the amount you're looking for left over.
