What is the name of your state (only U.S. law)?
I live in Texas, but my brother lives in Missouri where a girl he was seeing just had a baby that she declares is my brother's. Anyway, like I said, she just had the baby and they have arressted her because she tested positive for amphetamines. The baby i'm told flat lined and is now in stable but critical condition. What will happen to the baby? Can I get custody of this baby even if I live in another State? What should I do?

You have no legal standing what-so-ever to do ANYTHING relating to the child.

YOU cannot get custody of this baby. CPS will more than likely take the baby and place he/she somewhere and a GAL will be appointed. Your brother needs to file for paternity NOW so that HE has a chance at custody etc (and I hate to say this but thats only if this poor infant survives)
