Im not sure if I need to fill this here but Ill try. I ow several years worth of child support and have no problem of them taking my backpay if I was to win (ive been waiting almost 4yrs). Everyone knows whats going on, state, sons mom, etc.. However my sons mom is in texas and thats where I lived when all this court stuff about support happened in 2003. However Ive been living here in Indiana since then.

From what ive read I know they will take my backpay, when do I need to file a modification .. in the past ive tried to file but they refused to cause I have no income. However if I get the favorable and get a SSD monthly do I need to file then or is their something else I need to do? :confused:

I THINK (because you aren't clear... at all) that you are asking whether or not to file for a modification when you are approved for SSDI. The answer is yes, since they have denied you because you have no income. Being granted SSDI is a qualifying change in circumstance.
