Back wages. Company does not have money but will have.

Company XYZ, I work for, owes me paychecks for last 8 months. Besides my boss (owner) I am the only employee. XYZ has one more person working as a subcontractor. XYZ also owes money to him.

XYZ does not have any money and assets (just three computers) at the moment. I am quitting in about couple weeks.

XYZ, however, already has a purchase order for a next project. This is a substantial project that will pay about twice the debt to me. XYZ does not garantee me back wages from this project.

I am afraid, money will be spent from this project before I could legally collect.

Can DOL retrieve my back wages from this future (short-term) project? Is a future money-making contract assumed to be an asset that can be liquidated for creditors? Can money that are to come from the project be frozen and used for collecting back pay?

Were you an employee? If so, contact the Connecticut Dept. of Labor to file a claim for unpaid wages.

If you were an Independent Contractor, you probably will have to take legal action to get paid, just like any other vendor.

The reasons you were not paid are not your problem, and you should not be concerned with them. You provided a service. You are due compensation for providing that service. If you were an employee, you have more pull because the DOL will go to bat for you.

As an aside, there's three posts in a row about employees who keep working for companies who don't pay them. I do not understand this. Why? :confused: :confused: :confused:

Thank you for your replies.

I am a direct employee. I know, however, that at the moment the company does not have any money and assets to pay me back. If I file complaint with DOL, they can sue, but I will probably not get any money. If company is forced to pay now, they would have to go to bankruptcy.

Can DOL somehow alocate my back pay from a future project?

I expect they will require the company to pay you from whatever assets they have.

Listen - this stuff doesn't happen overnight. By the time the State DOL processes and investigates your complaint, it's quite likely this future project will be in the works, if not a past project. If I were you, I'd quite worrying about where the employer will get the money from and file the complaint. There is a statute of limitations on this stuff.
