What is the name of your state? Alabama.

The District Attorney in my county is trying to collect a check form me that dates back to 1989. They told me the check is for $5.00
and with fees it is now $60. I'm not sure if I made good on this check or not. Of course, I don't have proof of payment after all
these years. The company that turned the check over to the D.A.
has been out of business for several years,so I can't verify payment with them. Neither can the D.A.

Can they legally collect this after all these years? Does the collection of a bad check fall under the Fair Debt Collection Practices Act? If so, Don't they have to stop their efforts since they can't verify payment? They said they have an open warrant
out for me.

Thanks,

Perry Whatley

If they have a warrant issued back then, within the statute of limitations which was probably a year, they can still collect. Is the DA asking for your guilty plea to that offense as well as the money? If not, then you should be suspicious whether a warrant exists. The first thing you should do is get a copy of the warrant to find out if it does, and what offense you are being charged with.
