I recently bought a package of doughnuts at a convience store and took them to work to have at break.I didnt finish the package at work that night so I brought them home.I took them again to work the folloeing day.On my first break I decided ot have one so I took one out and bit into it.It crumbled a little but i thought nothing of it.Then I took a secound bite.As I bit into the doughnut I noticed something hard in it.I took the doughnut away from my mouth and looked.Sure enough, there was a piece of plastic about three inches inside.Luckily,I had told both of my kids,4 and 7, that they couldnt have a doughnut before I went to work that day.I saved the package,as well as the piece of plastic.I have tried to contact someone from manufacture of the doughnut, but I either get hung up on or I get an ansering machine.I'll l;eave a message, but I have yet to receive a call back.Is there anything I can do?

My response:

No, there's nothing you can do. Why ?

Because you suffered no damages. In order to sue for negligence or product liability, you must be able to prove some sort of compensable damages.

As the old saying goes, "no harm, no foul."

You should at least get a free box of donuts out of the deal. My wife bought a jar of strawberry jam. It was a well known national brand. About a month after buying it, my wife was spreading some on a piece of toast and saw something dark in the jam. It was a part of a cockroach. My wife became physically ill and missed a day of work because of it. Didn't bother me much, I like to eat strange stuff. I wrote a letter to the customer service department of the company and explained what was found. We got back a large envelope of coupons to receive free products and a check for $100 to have a nice dinner on the company. The secret is to write a letter, they probably get many phone calls a day with folks complaining about their products, very few will take the time to write.
