I'm back in! Its the Army but it gets me to Iraq to share sacrifice with my troops.

This was merly phase one of getting my former Marine record corrected (admin board was conducted in error, etc. BCNR overlooked evidence, etc)

I plan to field one more BCNR, one last chance to correct the record. We both know the outcome...now.

but it does extend my SoL for distric court.

I plan to have an independet reveiw by former JAGs (high level, former BCNR, or former judges) where do you think, if anywhere, professional organization or otherwise, can I solict such reveiws?

This is too complex legally for most major vet organizations.

Although, I am trying to recycle myself or should I say rehabilitate myself from an almost career military person to that of a physician, by going to medical school, I have assisted a number of current military and former military members with discharge upgrades and boards for records correction. During my 15 years on active duty, for four years, I taught a course in military rights and responsibiltiies and the application of the UCMJ. I have also helped non-military students with various legal issues, or have referred them to an attorney when it would be advisible to hire one. I suppose that comes from my days as a senior mililtary personnel specialist in the Navy.

So, in reading this post and a few of your others, I first want to thank you for your service to our country, and also commend you for persisting until you were able to reenlist into the Army. However, I have a few questions and tried to PM you last night, but your account is not set up to receive PMs, so if you would list an email address where you could be reached that would be appreciated. My basic question is how you were able to be successful in reenlistment and what paperwork procedures were necessary to achieve that goal. It appears that you were able to reenlist without satisfactory relief from a discharge review board or BCNR.

I have also asked that question of him without a response. He may be to busy to be monitoring this board or it might be some of that "I could tell ya but then I would have to kill you" information. :rolleyes:

In addition to the widely published request for pardon from former President Clinton and many informal requests to the USMC and SecNav, I filed a BCNR. In addition, I monitored each of the services as a Plan B if the BCNR was not successful. Pre-War an RE-4 code was a no-go with all the services due inter-service courtesy. I can only say the constant vigilance paid off. As the recruiting effort was challenged, more and more waivers appeared. A few of the more encompassing exceptions were age and tattoos. Lastly, I can only attribute it to commonsensical leadership, the Army decided that flat rejection of a RE-4 code was too severe as in some cases there were extenuating circumstances. These circumstances are now the basis as opposed to the RE-4 code. In short, it’s the narrative character of the reason the code was attributed rather than the code itself. If you are familiar with my situation, my RE-4 code was based on Misconduct. Cross referencing misconduct with Army regulations, it was wavierable. I made a case to the reviewing officer and it was waived. A no-brainer given the actual reality of my situation. Similar actions in the Army same time period may NOT have resulted in ANY adverse action. Caveat: if you have an Army Re-4 code for any reason, the Army will stand by the code and not qualify you for enlistment. Other prior service may qualify to request a wavier.

I am grateful as it provides me an opportunity to serve again, to gain that precious combat experience I would have lost, and solves a lot of the relief items I had previously requested. Lastly, it provides me a medium to prove my original character. I get another chance. It’s not the idea situation, but given the eight year fight, it is a solution. With each component either addressed or rendered moot, I am only strengthening the case against the USMC for further correction. And at this point, its really only vindication, administration, pay, and rank.

Congrats on being persistant and good luck making the transistion to Army green! Will you have to attend WTC and when do you go active?

Let us know when you ship and to what type of unit you will be assigned.

I am exempt from WTC and I'll will be with an Infantry unit. I wouldnt have it any other way. Hooah.
