What is the name of your state (only U.S. law)? DE

Can a person bail himself out of jail in Delaware? I am asking about a person who was arrested for driving with expired registration. This person also had an open container of alcohol. We suspect this person had a prior DWI arrest but we don't know for sure. This person is my wife's best friend's current romantic interest. He seems like a real loser with no job and seems to be drinking all of the time. He was arrested at 3pm on Sat and he called my wife's friend at 7pm. He said he had money to bail himself out but he wasn't allowed to. We were wondering if he is telling the truth.

Thanks.

it is a matter of logistics. While he may possess the money, and even have it in with the rest of his possessions they took from him when they locked him up, he cannot access the money to be able to pay his own bail. He obviously would not have access to anything outside of the jail either.

If someone is arrested with sufficient funds to bail themselves out on their person, they will be allowed to use those funds. Of course the bigger logistical problem is that we are a mostly cashless society now and any type of cash bail over a nominal amount is going to require help from a third party.

not in all places. In our local jails, you are not allowed to access your property being held for you during your stay so you cannot bail yourself out.
