I run a artist management company and one of the artists we represent has been offered a developmental deal with an entertainment company.

We are trying to decide if this deal is a good thing for the artist to sign or not. We have some concerns over one of the sections in the contact and would like some advice as to what exactly is meant by said section, you will find a copy of this section below. The clause we are concerned with in this section is clause (c) as we want to remain the management for this artist if they enter into this contract.

9. Promotion. Artist agrees to promote company and it’s partners in a positive fashion including but not limited to, logos, credits, spoken word, and/or broadcast.

(a) Artist agrees to maintain a suitable Myspace.com page that prominently displays association with company

(i) Artist is expected to display company in its top friend list, as is the common practice by members of Myspace.com

(b) Artist agrees to at all times be a positive representative of company and it’s partners

(c) Artist will at no time promote, represent, suggest, and/or associate its name or likeness with ANY entertainment based company without the expressed written consent of company.

(d) Artist agrees to properly display credits as assigned by company with respect to Producer(s), Engineer(s), Mastering(s) and any other credits deemed important by companyWhat is the name of your state?

Have your artist get written consent from the company, saying that you will remain as the artist's management company, PRIOR to the artist signing the contract.

I recommend having an entertainment lawyer look over the entire contract prior to having the artist sign anything, anyway.
