I have been reported to the Animal control for barking dogs. The person has also turned in about seven people in this immediate neighborhood. The allegations are false but most people are paying the $50.00 fine and hoping he will not turn them in again. I have chosen mediation and have the statements of all the homeowners adjacent to my house. The question is "Is there any legal recourse for this malcontent?"

My response:

Not really. Especially if, at the mediation, he's able to prove his allegations by way of tape recordings and / or video tape of your dog barking incessently.

However, I don't know what you two plan on accomplishing at a "mediation". This is because it is a "give and take" forum, and I'm sure you want your dog outside, and he'll insist that you either muzzle your dog, or keep it indoors or worse, get rid of your dog.

I don't foresee any "happy medium" in your situation, because you probably won't agree to any of these "fixes", and he'll be going after you in court for damages for "maintaining a nuisance" and abridging his rights to the free and quiet enjoyment of his property.
