battle for the thrown(porta-potty in residential zone

What is the name of your state (only U.S. law)?TEXAS A few months back we had something go wrong with our plumbing, it just stopped going down. We called a plumber who at initial inspection said we had a collapsed pipe, and would take 5000 USD to fix. So i went to the local bank, and after being told i didnt have an account with them decided id need to save half a paycheck for 3 months to get the cash to fix the issue. This of course left me with the predicament of not having a pot to piss in...literally, so we rented a porta potty for about 50 bucks a month. Every 6 days it is cleaned, and refilled with toliet paper and blue liquid. It has served us fine, but recently the city has been knocking at our door sayijng they were going to remove it! Now im no legal expert but i went threw our states codes and what nots and didnt see anything against it as long as it doesnt stink(which it doesnt) i think they are trying to bully me out of my house, or is this legal. If you look at ,my recent post you will see i was being harrased because they thought i was a drug dealer, and im very aware that counties use code enforcement to shut down drug houses (which i am not) how can i defend myself!! btw i just need another week or two and we are going to start the work on the plumbing.

Have you explained the issue to them? I suspect you may need some sort of permit to have the thing on your property.

As well you are required to have a functioning septic system. Lack of said septic system is a valid basis to condemn the home until it is repaired.

I suspect the problem is how long you have had the porta potty and they may suspect you have no intention of repairing your house septic system.

Good point. We have explained it to them, and they are fine with giving us time as long as we get it in writing from the contractors that we are going to be getting it fixed. Which luckily for me is where im at now, i just need to get the best price, from the best company and get it done. My beef tho is not wether the house meets code, but the fact that the city is over steping the lines by threating to remove the porta potty, it isnt legal or right. if they want to condemn the house til the repairs are made go ahead. I dont mind staying in a hotel for the next week or 2, but it feels ugly to have them vcome to my house and tell me what i can or cant have if there is no code,order., or law that backs them up!

I agree with Justalayman about it mostly being because it has been there too long. Since you said > recently the city has been knocking< ill lay odds they think you just aren't going to repair it, go to them and ask them if they have a program where they will pay for the repairs then add it on to the taxes spread out over x number of years ( if they do then do not mention that you almost have enough saved up to pay for the repair your self if they don't have such a thing then do your best to hang in there I guess and go ahead and get someone out there to begin the repair if they will let you give them what you have as down payment.

I have all the money needed, i just dont know how long its going to take, and yeah i guess looking at it, it maybe it seems like i wasnt going to fix it at all. but look guys and gals, my main issue is the over stepping of the government. I looked and looked, and no where did i see anything in regards to porta potties not being allowed on a residential property. I did however come across a news story in regards to a similar issue., The man had a porta potty by his outside pool for 5 years so the people who would often attend his swimming parties could use them. The neighbors didnt like it and went to the city to complain, and when the city ruled they could not do anything they went to the news. i almost want to leaVE the potty out there after repairs are made just to take this to the furthest level possible because i am an american citizen, and its my right to and duty to step up to a tyranical goverment even if its on a small battlefield

edit- sorry, i have a lot of ill feelings towards my local government. Im sure no one wants to hear about all my other battles with them. but i have many, and i win most! so im sorry i let my emotions seep out onto my post! lol

I suspect you will find a prohibition against the porta John through something like it does not meet code to a waste system for a residential property.

In other words; the porta john is not "up to code" and as such cannot be used.

please what? See, the country is the state that its in because of people like you. When someone wants to stand up for the rights we are seen as blowing things out of proportion simply because we dont just shut up and obey,,smh...So basically we are all shamed into not going with the flow, therefore allowing the government to run all over us,

LOL you should have just built a nice garden shed outhouse (only after learning if your city county codes required a permit if it was over a certain size so you would have kept it under that size) but seriously its likely if your in a city that they have a actual ordinance that requires homes to have functioning sewage systems so its not that its over reach but a huge issue is protecting ground water , which local rules can be all over the place. Where I live one cannot build a house on less than 2.5 acres if the home is going to be on private well & septic. Yet ive seen other places where the lots are a lot smaller and they still were able to put in a well and septic great way for everyone in a neighborhood to screw up the water table = every ones water

In my area a deploying a port-a-potty to a job site requires a permit, which COSTS MONEY and specifies how long it will be there...

Pull it together and stop pretending you are oppressed.

If you don't have enough money or credit to afford emergency home repairs, then maybe the American "Dream" isn't for you - it isn't even all that it is cracked up to be.

Agreed, and i love that right! And to not use my voice to insult the government would be a shame to the pre-2002 us military men and women who died to give us those rights!! Its a beautiful thing!! anywho, they are coming monday to fix my pipes as for the can..im keeping it til they come with a warrant to take it.. after that i will pursue my options. It really is fun to battle the governments in the courts when it comes to matters that do not affect ones freedom or saftey i might add.

I do have the m0oney and the situation is being rectified. As for the porta potty being a sanitation issue..how so? they are enclosed in an almost airtight cubicle, they are cleaned on a regular basis, they are filled with chemicals that neautralize the order, and its off in a far corner not easily seen. And i am not pretending i am opressed. 5000 dollars on the whim is a lot of money to someone who only makes 62k a year so please shhhhh, again i will not be shamed into fighting for what i think is right.
