I filed my motion for modification in Sept. What I filed was a Motion for Modification of Physical Placement and attached a parenting plan, in the motion I requested that if the court did not find grounds to modify physical placement that it grant a more clear order, that the parenting plan could be used in either scenario by changing the words Mother and Father as needed to reflect the CP/NCP status.

My ex's says ( Iknow- why am a listening to him!) that his attorney says that all I am asking for is a more defined order....

Should I- or even CAN I resubmit the motion (or clarify it) and so they do indeed know I want a change of placement, should I submit 2 parenting plans; one for if I get the mod, one for if I don't?

I don't understand how they can be confused about this, the judge asked me at the first hearing if I was wanting a change in placement and I said very clearly YES.....

So should I resubmit and clear up any confusion or is it not necessary?

Without reading the initial motion there is no way to tell you if a subsequent motion is required or necessary.

However, you do have the right under the WI rules of civil procedure to file a separate motion to alter physical placement and the court can combine the seperate motions into one or ignore the second motion if it finds it covered in the initial motion.

Thank you so much BB!!!! I think I will file a supplemental motion- just so everything is clear, and like you said, if it gets tossed then ok, but if it's needed then it's there. Thank you again!
