because of Sunday prem/no o.t.?

at my job we get time 1/2 on Sundays. I worked 45 hours last week and was expecting 5 hours o.t. in addition to my Sunday premium. I never worked Sunday and had o.t. in the same week before. when i did not get the 5 hours o.t. i asked why i was told because i worked on Sunday and got that premium that i would have to work over 48 to qualify for o.t. In our union contract it says there will be no pyramiding of o.t. & Sunday premium. I always took that to mean if you work o.t. on Sunday you won't get 3x. am i entitled to the o.t.?

GREAT IDEA!!! why didn't i think of that? oh wait i did. i called last week . it usually takes 2-3 months before they ever get back to someone, that is , if they ever get back to someone!

Here's something you evidently didn't think of either.

We have not read your union contract.

So if you want an answer that takes the terms of your contract into consideration, you're going to have to wait for your rep to call you back.

And, just for your info, you don't need to be paid your overtime rate more than once for the same hours, at least by law. If the union contract says something different, then that would control. However, I must say that I manage the payroll dept. for a large city with 9 unions, and none of ours has that requirement.

yeah, i got that part...you must not of read the last line of my post! The only reference my contract has in it as to regards to this situation is that it says there will be no pyramiding of o.t. and Sunday premium, nothing else. and since it's a contract not a dictionary I do not know what that means. I thought with all the new o.t. laws someone might be able to tell me if they can do that since none of my o.t. hours fell on a Sunday. But i guess I'll wait the 3 months to find out

I read the last sentence. What I explained to you is exactly what the phrase "pyramiding of overtime" means. So, if that is what the contract says, then, no you don't get 3X your rate. And BTW, if you have to wait three months for the union rep to get back to you, you have a lousy union rep.

I know I don't get 3x. i am scheduled 40 hours a week. if I work anything over 40 it is time 1/2 for how ever many hours I work over 40. I usually don't work on Sundays but if i do i get time 1/2 for how ever many hours i work on sunday.Lets say last week i was scheduled on sunday,then on Thursday(one of my days off)they call me up and say can you help us out for a few hours.I work 5 extra hours thinking its going to be time 1/2 because it would put me at 45 hours. why would Sunday(which is the first day of our week)bonus hours take away my over time hours? BTW, it's not just my union rep that is lousy, it's the whole union that is lousy!

OK, one more time. Sunday is the first day of your work week. You are already getting 1.5 time for working that day, even if you don't work 40 hours total in the work week. Let's say you work Sunday through Friday, 8 hours/day. That's 48 hours. You would be due, legally, only 8 hours 1.5 time. You have already done that by the fact that your Sunday hours were paid at 1.5. So, no additional pay due by law.
