I live in wisconsin. How do you know when you would get workers comp benefits? And if you are eligible how soon before you start recieving benefits?

you get benefits if you are injured on the job...Have you been injured?

If so, when?

What were the injuries?

Did you lose time from work?

If so, how long?

It was tendonitis. tennis elbow to put it simply. I didn't have time off of work but was on light duty. I went from making 15 an hour down to 8.

Since you are already on light duty, I assume the company is aware of your claim...you may be eligible for temporary partial disability benefits based on your decrease in hours, but that can vary under Wisconsin law...You wil have difficulty obtaining an attorney since currently your claim is not worth that much money...but I would check the Wisconsin states regarding temporary partial disability...

The name of your employer's workers compensation insurer is registered through the department of labor in Wisconsin(a requirement by law)...since you are not represented you can contact the carrier directly...be careful tho...because they goal is to get you to settle within the schedule...

I would also suggest contacting a workers' compensation attorney in your area...they work on contingency (no money up front) but if you end up with a perm rating they will make something in the settlement... You left many of my questions unanswered so that is the most I can do for now.

Some people at work told me that workers comp picks up my wages that I am not receiving because of being on light duty. I was on light duty for 6 weeks and had returned to full work, because one thing couldn't take the cut in wages. I had talked to someone at the insurance company and she told me ( she has my claim) that I might and might not receive money. I've called her twice last week and got her voice mail if she could at least let me know what was going on with my claim and I never got a call back. Other people I've been told have been cheated out of their wages by my employer through workers comp and they found different jobs because they couldn't work for $8 an hour. How can I find out if I am entitled to partial benefits if no one will get back to me. I already have a lawyer, but I haven't contacted him. I've been told by several people that my employer just likes to screw people over when it comes to workers comp. I really don't know what to do? I'm lost at this one. Am I fighting a losing battle?

Have your lawyer contact the insurance company...The rumor about your employer is false..the employer has no choice about the payment of benefits because the employer has insurance. The adjuster may not be returning your calls because you are represented..technically she is not allowed to talk with you...you need to be on the lawyer's butt to find out what' going on.
