What is the name of your state? Texas

My brother is the executor of mothers estate. There are five beneficiaries. The executor has given one beneficiary a cash distribution twice as large as what the others got.


Can one beneficiary receive more than the others or should distributions be paid equally?What is the name of your state?

The will states all beneficiaries receive the same. At about two years we all received a distribution of about half of what we are owed. One brother is to receive another distribution to move out of moms house and not testify in a civil suite the executor has against us.

Again my question is: Can one beneficiary receive more than the others or should distributions be paid equally? What is the name of your state? Texas

Yes and that depends entirely on a complete review of all facts.

Have you seen the will? If you don't have a copy of it you need to get one from the courthouse. Was this executor required to post an executor's bond or not?

This does look a bit odd, but you can't automatically assume that the payment is incorrect. It may have included payment for an asset that the person was named beneficiary of outside of the estate.

Wait until probate is over and the financial records are filed with the estate, and then look at the records or have your attorney review them to see if anything inappropriate has taken place. In fact, you may want to get an attorney now or at least attend one or more of the probate hearings to bring this matter up before the estate closes.

First Thanks for all replies

I have a copy of the will. One brother is to receive, or is owed nothing more than the other one.

Probate has been going on four years and shows no sign of closing any time soon.

"Attend one or more of the probate hearings". How do I find out about any probate hearings and when and where they might be taking place? I have been told by the estate attorneys that they don't work for me they work for the executor.
