Finally, a potential reason for me to cheer up-- got word from the criminal atty that a hearing is set for Monday morning on the visitation issue...we almost had a deal in criminal court this past
tuesday where I would plead no contest, no admission of guilt on the made-up domestic violence charge, I'd go to classes and the no contest could not be used against me in the civil court actions.
As I would have to be on my best behaviour for a year, I insisted on supervised pick-up and drop-off so as not to give my ex another chance to set me up, we got hung up on that and then when the prosecutor asked us how we wanted to proceed on the
"restitution" i.e. paying for the window I never broke and the ER
visit, I tore up the plea sheet and told her I'd rather go to trial.
Even though it's only a few hundred dollars I will not give them the satisfaction of taking responsibility for something I did not do.
I'll take my chances with a jury.

Still no phone calls from my daughter, I'm supposed to see her for another supervised visit this weekend with the supervisor taking notes in a smelly courtroom cafeteria. Joy...this nightmare can't last much longer though, my ex's web of deceit is starting to untangle.....

You know pal.. once a jury hears of all your problems this woman has caused and the lengths she has taken to stop your relationship with your child... and the fact you just petitioned for custody because of her denied visitation etc etc.. then there is more than enough reasonable doubt to come back with a not guilty verdict. When does this go to trial? Does the prosecutor really think he has a case?

Thanks LB, both the prosecutor and my attorney (who recently worked in the prosecutor's office) got a taste of her on Tuesday
while trying to deal with her and her father (the real instigator of all this) as the "alleged victim", I think they came away with a real understanding of what's going on. There's no way the state wants this to go to trial but the ex is being loud and persistant to the point that the prosecutor actually told her she couldn't utilize the criminal court process for gain in her civil case.....Although my lawyer warned me a trial could go either way, my gut tells me what you said, no six people are going to convict me once they hear the entire situation, so bring it on baby.

Maybe she'll just snap altogether one of these days and they can put her in a padded cell!

Tell 'em you'd be happy to pay for the ER visit if they had also done fingernail checks on the two of you.
