I am an agency RN. I was injured in Feb 05. I received a labral tear, a rotator cuff tear, and my ac joint is lifting. I have been on workers' comp. since the injury. My doctor removed my restrictions, once, and I was able to go back to work. I was placed on restrictions of no pushing/pulling, no lifting greater than 10lbs, no overhead lifting, no climbing, and no physical restraints after seeing an orthopedic surgeon in April 05. On May 24, 2005, the orthopedist recommended surgery. I spoke with the DON at the facility where I was working and she agreed to let me come and work back at the facility as long as I did not violate my restrictions. I was involved in an incident on 5/30/05 which required me to use physical restraints and push/pull (I am a psychiatric nurse working at a state facility). I was punched in my injured shoulder by a client. After this incident, my employer pulled me and stated that I did not need to work anymore due to the unpredictable clients at this facility and my work restrictions. My employer called the incident in to workers compensation. I never went back to see the doctor because I was awaiting approval for surgery which was already recommended,and it was the same injury. Well, I have been out of work since May 30, 2005 and have not received a check yet. The adjuster told my lawyer he was sending my checks two weeks ago; however, when my employer inquired, he told me the adjuster stated he was still investigating. He has not approved my surgery and has not sent me any checks since I've been out of work. I would work but the restrictions are all inclusive. As an RN, my job requires lifting and pushing/pulling. I can't work at the hospital, the nursing home, home health, in a doctors office, case management,nor in psych. I would like to know if there is anything I can do about this adjuster and his indecision. My lawyer stated that he was going to file for some type of penalty that he could only do once I requested it. His statement has made me wonder if I am supposed to tell him what to do. I don't know the penalties, procedures, or protocol. I am just feeling a bit frustrated and any information would be greatly appreciated. Thank you.
