biological fathers relenquish of rights

my husband and i just went to the courthouse for him to adopt my daughter.

we filled out all the forms and had them notarized. the woman said that since we were married 6 months and that her fater abandoned and has never seen her that we don't need him to sign relenquish of rights. is this true and does his family have a right to see her?

Yes and no

Yes it is true you dont need his permission for the adoption as long as you have made an effort to contact him and also if he does not pay support.

You may have to show poor that you have been abondoned to the judge.

When we were trying to have my husband adopt my daughter our lawyer told us to legally have it proved that biodad has abandoned the child we had to do a few things:

A. send certified letter w/return receipt to last known address of father...notifying him of intention to adoption

B. same as above...but sent to last known address of jobplace

C. and last ...in the newspaper (you will need a legal expert to advise you on how to do this) you will need to advise bio-father of intention

Doing it this way will help keep bio-dad from contesting the adoption in the future, because you have shown "exhaustive efforts" in making contact with him, and he was not to be found.
