What is the name of your state (only U.S. law)? CA

Me and my husband have been together for more than 10 years and been trying to have a baby for the last 5 year. We have a friend that will give her baby for us to adopt. When the baby is born she is willing to give up her parental rights.

My question is, once she give birth can me and my husband's name be on the baby's birth certificate instead of the biological mothers' and without going through the legal court process?

Absolutely NOT.

You can't become the baby's legal parents at ALL without going through a "legal court process". You need to hire an attorney if you want to do this right. Otherwise you will be in for a heartbreaking fight if the birth mother changes her mind sometime down the road.

Also, there is not just ONE parent involved. Dad would have to agree to give up his rights too.

so youre asking if its ok to commit fraud? absolutely not. do it the legal way, or risk not only losing the baby, but possibly facing criminal charges.

Where is the baby's father, and what does he say about your wishes?

Good grief! Get a Home Study and an adoption attorney and do this properly and legally. And make sure dad is agreeable about his child being adopted.
