BK discharged a year ago

MN. My bankruptcy was discharged in June of 2004. I filed chapter 7.

At the time of discharge I was unaware of needing a reaffirmation agreement. I had a vehicle I planned on keeping and continue making payments. When I asked my attorney he said that it was to late, the discharge had already occurred. But that sometimes its better for people to not sign a reaffirmation agreement and continue making payments.

I contacted the lender who almost refused to talk to me. They told me to continue making payments, but they will not call me or send out any statements.

So I have been doing this for a year and today I check my credit report and the started reporting my last month on this account.

I called them and told them that because I never was offered a reaffirmation agreement and one was never signed, they cant report any new information to the credit bureaus. I mentioned that I still was protected by the bankruptcy laws.

They told me to dispute it on line and that it will be cleared up. I dont want this my credit report because it shows the same account twice, once in bankruptcy and the other like its a new debt.

What is the truth in this matter and what can I do to get this off my credit report.

They cannot report a discharged debt as if it was a new collection/open account. They told you what to do.. dispute it with the credit bureaus - included in bankruptcy and include the date of your BK filing AND your discharge date.
