I was arrested in Louisiana for DUI. I refused the FST at the scene and blew .011 at the police station. I also seemed to have passed all the taped tests at the station (completed them all no problem). I was sleeping in my truck at a gas station when I was arrested. I was pulled from my truck by several police officers and told that I was being arrested for DWI. They asked if I had been drinking and I told them I had a few beers earlier that evening (it was about 10:00pm). I was detained for most of the night before posting bail. I told the arresting officers that I had only slept about 4 hrs. in 3 days but that didn't seem to matter to them(?). What are my options and do I need legal help? It seems like this should be thrown out...

Your options are limited. And I'm assuming you meant you blew a .11, because a .011 is under the legal limit. First advice is NEVER NEVER NEVER blow. Downside of not blowing is you'll go to jail. The upside is that's evidence they can't use against use....thus harder to prove a dwi. One doesn't even have to consent to the field sobriety test.

Ok, going forward, I'm assuming this is your first dwi. You pretty much have three options. Hire a really expensive good attorney and he may get you off all the way. Or you can take probation (usually two years) and community service (usually 80 hours). I suggest NOT go that route. Last option is jail time. On first offense you'll most likely do 10 days. If you don't have the $$$ for that lawyer, do the jail time. Because if you take the probation and did any little thing that might revoke your probation, you're in for a world of hurt.
