Ok not sure if anyone has any advise but it's worth a shot. My Fiance and his x just finished their year and a 1/2 long battle. The entire time she was asking for $1300 a month. She was awarded 105.69 a month she is a bit pissed to say the least. So now my question is if she gets pregnant and has a child with someone else will this effect my fiance's child support? how about if she quits her job? I know she is trying to find a way to up that $$. Just wondering if there is a way for her to succeed. Thanks:confused:

Were they married or are they still? If they are then if she has a baby while they are married it's more than likely in your state that he will legally be the father and required to pay support unless he gets a DNA test asap and presents it to the court.

If the answers no, if she has 100 kids by someone else your fiance will not be required to pay support on them and they can't up his amount of support based on how many more children she has. He is only responsible for his child.

They were never married actually we are getting married on the 24th!:) So good we don't have to worry about that. What if she quits her job and has no income then would she have to file for mod to cs claiming her income has changed?
 
I'm sorry, but does anyone else ever have the problem of thinking "bowel movement" when bio-trolls are called bm's?

Maybe I'm just really tired...

Well bowel movement and this bio mom go hand in hand, sorry just my opinion since I deal with her on a regular basis.

About the income, at that amount I doubt it would be enough to cause a change in the amount of income. I'm just going by what I have figured up on the calculators in NC. Usually if someone's income change changes the amount of child support according to the guidelines (usually between 15-20% depending on the state) that is grounds to modify.

I'll give you an example and this should help you coolmom. This is what I was talking about.

If she's making (1300/mo) and the NCP is making 1200/mo with 3 kids in the order, his income would fall in the gray shaded area of the support guidelines, which means they only go by his income and not hers. So in that case her income doesn't affect it all.

So it just depends. The best thing to do is to go to the child support calculator and play around with it.

Thanks for all the advise. I know this woman and she is not happy with 100$ a month when she had herself set up for $1300. Now we are worried of what she can do, because she will try anything to get more $$ I just wonder what her options are. Thanks again.
