I live in Illinois, me and my husband bought a two unit building with his brother and sister-in-law. His brother is now getting a divorse and we would like to keep the house with him, and just remortgage her off. She refuses to be bought out and refuses to pay any of the bills while she is here. the judge has awarded her ocupance of the house until march.She has been turning the heat way up and opening all of the windows because she isnt paying for it. she is doing everything she can to make us miserable. The divorse will not be in court for two more months. The brother-in-law is staying with parents and friends. We are stuck with her in the top unit. There is only one pin # on the building and we have one mortgage, the sister-in-law is on the deed but not the mortgage. The lawyer has told my brother-in-law that he and his wife cannot sell the building but me and my husband can. Do the other two have to agree with us on the selling price, or is it our decision? Can she say that the apprasal of the home is not enough and say she wants more money? If this is possible we will never get out of this situation. She is sure to discourage buyers if anyone comes to see the house.
