Normally my bank has handled bounced checks in the past and have charged me their fee plus a 6 dollar fee per day til I settle it. Out of the blue I get a notice of a bounced check that they had returned, when I contacted the bank they said they had absolutely no record of the check being returned. I called up the collection agency the account was sent to and asked if I could set up a payment plan, they said no pay now or we will "could" sue you if their "attorny decides to". Well today I get the summons and complaint, but when I contacted the law firm they claimed I owed like 100 dollars more than what the complaint said. I was quite confused so I went over the summons and complaint a few times, then I realized the complaint had no signature as it says is required. Does this mean that the complaint is meaningless and will just be dismissed when I show up in court? If so should I contact the state bar and file a complaint against the lawyer? Or should I contact the collection people tell them I can pay the check, and the first fees they charged now that I can actually pay and tell them that the law firm screwed up? Or should I take it up with the people who actually sent the check to me in the first place and try to buy back the account for the full ammount of the check and fees?
