What is the name of your state? tx

I have a court date on the 21st. the ag's office is taking my ex back to answer for his failure to pay childsupport for the last six years. He claims he is going to get his support lowered. I only get 230.00 a month plus whatever they order for the arrears. He is currently unemployed and living off the ssdi that his two sons get for being disabled. The ssdi payments pay the house, utilities and whatever else they need. I am not sure but I think he also get help with buying groceries.

He told me last week that is trying to get a job that will pay anywhere from 1500 to 2000 a month and only require him to work 2 to 3 hours a day. that is obviously 14 to 21 hours a week. (the job is in the oil fields maintain the oil wells)

My question is, is the state likely to allow him to remain at this level of work or will they require him to get a second job and work a full 40 hours a week? I have never had an increase in support and would like to see my ex have to work as hard as I do to support our child. And if they order him to get a second job to bring his work up to 40 hours a week, about how long would they give him to find that job?

My husband pays his child support based on a 40 hour work week, so I feel that my exhusband should as well.

I really am not trying to be greedy and self centered but I know so many of my friends around here that go back every year for increases and get it and I am constantly either not getting the support because he doesn't want to pay it or he's trying to find a way to show the state he is too poor to pay support, when if he would just get off his butt and work a little he could afford too.

He is currently unemployed. As a result, the court must impute an income to him of 40 hours a week at federal minimum wages. Once he is employed, the child support will be based upon his income not upon the number of hours per week that he works.

that's kind of what I thought. Just my luck that my ex would rather live off the government than pay his own way in this world. It seems that no matter what I do he'll manage to keep me from getting an increase in my support even though I do need one badly.

The cost of raising children is not cheap as I am sure you know, just really irks me when people in this world spend more time trying to figure out how to keep from supporting their children, than just working do it because they should.

Yes, there will always be those who are willing to forego having things themselves in order to prevent their children from a former relationship from having them either. Of course, they see this t as "I don't feed the calf after I have sold the cow." :(

you are correct! I just wish there was a way to compel such people to do their part but as you said the are willing to deprive the child just because they don't want to pay the ex spouse anything.

I just wish their was a way to get a cost of living increase or something or other like that but I am sure there are ways around those too.

After six years I think I am more than due an increase but like I said he and his wife would rather live in poverty than have to pay anything for his daughter with me.

Hi Ktarra. I posted a few weeks ago, because I was going to court in Dallas county for a reduce to judgement and downward modification that was requested by the ncp. Everything that could be argued, I argued, pro-se. Every penny, every dime, every dollar. My main issue was that he doesnt pay it as it is, and he works, so how dare him bring me to court, when I have never done it to him. So I wanted him to think two or three times, before he did this again and guess what, child support was doubled. I did my homework. Printed off his earnings from his company website. And could counter with fact when he lied. I also argued cost of living, and the fact he was paying based on a 7 year old order. Not a leg to stand on, but I asked for it. And he agreed to $30 more a month for cost of living. I guess after we watched 7 people go to jail that day for non support, he wasnt trying to let the judge decide, especially since he's hasnt paid in 2 years.

So my point is this, u can argue anything u want. If he is in the wrong, and not paying, ask the AG a few times about jail sentences, and license suspension. Let him know u have the law on your side, and u know it.

our court order is from 1996. there have never been any modifications to the support, either up or down. I have never asked for an increase because I figured that he didn't make enough to pay what he's supposed, Now I have just come to the conclusion that he just doesn't want to pay at all, not that he's not capable of finding work to pay the bills, he's just too lazy too!

How did you argue the cost of living? Like I said I have never gotten an increase and I sorely need one. As you know kids only get more expensive as they grow.

Any more info would be appreciated?
