Boy do I need some help!!!!!!!

What is the name of your state? Iowa......Husband has been in nursing home with early stages alzheimer for the last year and a half..costing me 3300.00 a month out of my pocket every month....there is a farm that was left in some form of life estate so he recieves the income till he dies then it comes to me...his wife....and at the time of my death or if I should remarry it goes to my 3 son's......the state of Iowa is refusing to give me assistance because they are using the entire value of the farm against me even though I have been informed that it cannot be sold...and never can be till it reaches our kids and by then we are dead.....they consider it a resource....the farm income which I have been managing for a few years now...share cropping...does not come close to covering all the medical expenses....what are my options????.....Have gone thru most of our savings paying his bills....I am 7 years younger than he is and I still have a life to live....I don't understand why I have to be penniless because he happened to get this horrible disease....I am considering a divorce ....but.....if the income from the farm does not generate enough money to pay for his care can they just throw him out in the street?????

Do they give you the option of an appeal? Did you explain that this was specifically a life estate (which they are probably too dumb to understand)?

You may want to consider asking an attorney to help you state your case if they give you a chance to appeal--it sounds like they don't understand your explanation of the true facts.

Iowa.......I have appealed and appealed and appealed........to be honest I think they try to bury you in so much red tape that you sooner or later just say forget it and give up.....so....can they throw him out in the street???....can they refuse to care for him?
This life estate is 20 years old.....if all mentioned parties sign ...can it be sold?? Thanks for you responses I am just going nuts here.....I will be out of touch till October 6 so any help I sure appreciate it. Thanks so much

Please consult with an Elder Law attorney that is very familiar with life estates. This matter may require intervention at the state capitol level. The nursing home can have your husband removed for non-payment of his bill.

Getting the run around by state

Iowa........I need an elder attorney that specializes in life estates.....husband has been in nursing home over a year and a half. Its breaking me.....I have tried and tried to get assisstance but keep getting denied because of a farm the was left by his mother 20 years ago.....the will specifies that my husband...her son.....gets the income till he dies then at that time the income passes to me until I die or remarry then at that time it is passed equally to my 3 sons. So I have been told the farm cannot be sold....and it doesn't generate enough income to pay for his care...at the same time it is my main source of income having had to quit my job to care for him when he got ill........by the way I guess I should tell you he has early stages alzheimer.
I am the power of attorney. Anyway the state is holding the full value of the farm against me so I don't qualify for assisstance.....and all this time they keep saying spend your money down. Well so I did stuff to my house to improve it and the money has been spent down to a level that keeps me from sleeping at night and after all the spending that is when they finally told me I needed 3 appraisals on the farm and that is when they told me the value is too much to ever get assisstance. I have appealed and appealed just to get turned down time after time. At this time I am disputing the appeal and they said they would have a review and I will be informed in 3 to 4 months....good grief that is another 13000.00 to the nursing home. My husband is 64 and I am 56. I have a long life ahead of me and my savings is all going to the care.
We have saved our whole lives to end up broke when I am suppose to be entering my golden years. This seems so unfair to me. I am going to have to file for a divorce but my concern is what happens to him if the farm income doesn't cover the expense....they just throw him in the street? And how do I keep up this expense and still live my life? We have been married for 38 years and they have been horrible years....the marriage ended years ago for all paractical purposes but I still can't just pack up and run off and leave him to the wolves. I still have to do what is right and what my heart tells me is right.
So any advice I can get would be greatly appreciated. Thanks so much.

At the top of the page is attorneypages.com. You can use that. Many probate attorneys also do elder law. As previously stated, try going to your state capital office, including the governor.

No they don't throw Alzheimer's patients out on the street. When all the money is gone then they qualify for medicaid and the state pays for them. However, some nursing homes will indeed get rid of patients with money problems. He may end up in an understaffed crummy nursing home when the money runs out. The best thing to do is to contact an elderly care attorney immediately for advice. Good luck.
