Hi I was wondering if it's worth my time to seek a lawyer to file a claim against my employer for breaching the contract.
At the time of being hired I was offered a salary plus bonus structure (up 25% of my salary per month based on management performance), however 3 months into my employment and no bonus structure has been set up even though I have been reminding them constantly regarding this matter. Now that my review has been completed, I am still designated as a 1099 employee and no eligible for the 2 weeks of vacation.

There is no such thing as a 1099 employee. You are either an employee (with a W2) or a contractor (with a 1099). I suspect that they are illegally classifying you as a contractor. I think its time to start looking for new employment.

I am currently looking for a new position already and have been lucky enough to secure one.

The company's deceptive behavior must be punished to prevent them from taking advantage of hard working honest people. They are misclassifying me to save money (illegally).

Should I seek a attorney?

Report them to the state.
