What is the name of your state (only U.S. law)? Minnesota

Does anybody know if the law in Minnesota allows a person to break a lease if they are going to purchase a house. I had been told by 2 or 3 people they thought so, but can't find anything on it.

My landlord is not being cooperative. I was trying to purchase a home and he refuses to return the landlord statement. My lease expires 9/30 and he is waiting just long enough so I can't give proper notice. I have asked for a month to month but he prefers a year lease.

Any suggestions.

Start here. But, no, there is no MN law that states you have the right to break your lease without penalty simply because you chose to buy.

You can certainly break your lease, but you should review the terms of it to find out what it is going to cost you.

(I am in MN.)

Thank you for the quick response. I didn't think so.

I am going to ask my landlord to do a month to month, or add a clause to my lease that states I can break it to purchase a house.

You can ask.....Do expect the landlord to attach some sort of penalty attached to that clause if he/she approves it.

Whats frustrating is I started the house buying proces about 60 days ago, and the landlord refuses to send a landlord statement. I have lived their for 4 years and I find interesting that he has all the rights and I have none.

I pay my rent on time, all I want to do is try and buy a house and he is holding it up because he refuses to cooperate with the mortgage person.

I have done all of this in good faith and he is intentionally throwing a wrench into things.

Then submit to your lender copies of of the rent checks/bank statements going back however far they'd like showing that your rent was always paid before it came due. Could mitigate the "no LL statement" they want.

I was thinking of that as well. Problem is the landlord dilly dallied so long I would have to submit them and get the pre-approval by Wednesday August 31, 2011. That won't happen - it takes a week for underwriting.

My lease expires September 30 so I would have to give notice by August 31 and I can't. Otherwise I will be forced to sign a new lease - that is my dilemna.

What the LL is doing is wrong. He should have sent the letter. But showing past history of rent paid, I think, would help.

Anyways, I go ahead and give him his 30 days notice and find a place that would rent by the month. Hotels go by the week or month. Store your belongings in a storage bin and keep the least amount of things that you would need. This would save you in the long run. Signing another lease and breaking it will cost you more.
I have "batched" like this a few times, with children, waiting for quarters on base. It's not that bad as it sounds.

KK get that notice in the mail tues if the LL is not in the same general area , as stupid as it is mail from Zimmerman to my home 24 miles away can take up to two days to get to me so get it in mail via certified mail Tuesday , All over the metro and smaller towns are self storage units rent one . as soon as notice is sent begin hauling out your xmas stuff and heavy winter stuff then start thining down the other stuff like maybe halfing your towels linens , your cooking stuff and get it into storage then in the later part of sept more and more things , this way by the end of sept you will be out on time and will have ample time to clean and take pics of how nice you left the unit. Your LL doesnt have to grant you a month to month extension , and since your LL has refused to cooperate with your needed information request for you to cleanly leave dont be surprised if they wont go M2m . If alternate methods of proof are allowed use them. If you have to rent a sleeping room for a month or even a furnished apt or just bunk in at a friends (with payment) you would be better off setting it up now do you can leave unit on time. The get out of lease if you buy is ancient MN n ICE myth unless its written into a lease or is a city /county /state law it doesnt count.
