I just returned from a small claims court action yesterday. I sued a purchaser of a puppy for not performing his obligations of a contract.
The purchaser of the puppy was by contract supposed to perform 2 tests on this dog at 2 years of age, and BEFORE any breeding. He not only bred the dog at 10 months but then continued to breed him 4 more times. He has not done any testing on the dog for heredity type defects, namely the dogs hips and eye clearances.
My contract stated these were to be done at two years old and that he would owe $5,000 per incidence if he choose to violate this agreement.
The judge has said that this is not an
enforcible" contract because I "SOLD" the dog to him, he is under no way obligated to abide by this contract. I sold the dog to him and he owns the dog and do with him as he wishes.
Is this the case in California??? Also, if I had remained as co-owner on the dogs papers would have that made a difference?
