i have already posted a question regarding my brother beintg incarcerated in indiana and the biological mother of his child relinquishing her rights. i am wanting to know which state has jurisdiction indiana or south carolina. here are the facts:
1. my brother will get out of jail in December 2001
2. he has only seen his son 2-3 times in his life
3. his name is not on the birth certificate
4. paternity has been proven in indiana
5. child support was ordered in hamilton county in indiana
6. child support has not been pain on a regular basis because my brother has been in and out of trouble
7. the biological mother moved to south carolina with the child about 2 years ago
8. she gave a couple in south carolina temporary, then later permanent custody of the child
9. she has now relinquished her parental rights
10. the couple in south carolina now wants my brother to relinquish his rights so they can adopt
11. my brother knows that he cannot provide for the child, therefore he wants me to take guardianship and possibly adopt the child so that he may have some sort of relationship with the child
12. i am willing to do this, even though i have never met the child who is 4 years old

if anybody has any advice...please help!

NOt up to you to decide who has jurisdiction and which venue is proper.

You need a family law attorney, plain and simple.
