The company I work for filed Chapter 11 about 6 weeks ago. I have some knowledge of the company financials, but I have no ownership nor am I an Affiliate Officer. The company has a total of 15 employees.
The owners clearly are hurting for cash, but I don't know how bad. The line of creditors is long and deep.
After the reorganization the Owners had difficulty making the first payroll. They singled two staff members (myself and another) to not get paychecks because we're the most senior employees (but for no other reason, our pay rates are about the same as other staff at this time). The second payroll came and I didreceive a check, but not payment for the missing check. Most staff have received 2 paychecks since reorganization- I have received only one.
My question- under reorganization do the Owners have the authority to selectivly decide which staff members should be paid? Does it make sense to discriminate against me?
