I posted earlier and now we're supposed to close tomorrow morning. We've done everything buyer has asked (new roof, went down to appraised price PRE-new roof). She signed an ammended contract that said if appraisal re-appraised house b/c of new roof, she'd go back to purchase price. 2 days before closing (yesterday) she called and said she would not pay a penny over 1st appraised price. We said fine, we just want to close. She said she really just wants OUT: she's regretting even buying our house b/c she hasn't sold hers yet (she doesn't have a contingency contract).
We are supposed to close on a house on Friday - we've already paid a deposit (contingency) but paid for the inspections, appraisal, application fees, etc.
So now I'm scared she's just not going to show up tomorrow for closing. She's been playing games with us the entire time! We have a $5000 binder, but if she doesn't show up tomorrow, do we have a case against her for 'damages' and breach of contract(s)? We've paid for a new roof that 3 roofers said was unnecessary, we've made repairs here, we have her signed sheet that she's pay purchase price, our sellers did repairs needed for US to close, so they have put out money, etc. Or does she 'get' to just walk away from all this and only lose her binder????
