Buyer Rebate at Settlement

We are buying a house and our buyer realtor is giving us a 2% rebate on the sales price. Plus I am using the builder mortgage company, which is giving us 1% back of the total loan amount.

According to the loan officer, since the amount that I am getting back at the settlement is higher than the closing cost, I will have to deal with my buyer realtor off-line and get the credit from her after the settlement. Is there some kind of law that is preventing the settlement / loan officer not to give me the rebate that I am entitled to?

How do I handle this kind of situation? What if the realtor never pays me back?
