By law, who is right?

Here is the situation:
Landlord is having economical problems and decides to sell the apartment he is renting.
The building has a "move-out fee".
The tenant would have not moved out if the landlord didn't "kick him out" in order to sell the house to make money to pay his debts.
There is also to say that the tenant never really payed any move-in fee either so the condo board doesn't even know he is staying there, tenant didn't know he had to pay a move-in fee and landlord didn't mention it either, so basically, in theory, Condo doesn't know tenant is staying in the apartment
Now, who has to pay the move-out fee in this case? The landlord, who is the owner of the apartment, or the tenant who was kicked out and was never officially on the condo tenants list?
Just curious what the law says about it.

What do you mean by US law only? This happened in NY - as far as I know that is in the US.

You didn't post what state you were in. There was a reason that question was there when you started this thread. A lot of legal advice is state specific and you didn't specify.

The problem is that you dleted the question that aoutmatically presents itself in every single thread starter---What is your State? (US Law Only).

When you do so, we cannot know which state's laws apply to your situation and therefore can only make the assumption that your issues are not subject to any US laws.
