C.A.S can they do this

an incident occuried at a mall with my ex g/f and my 3 year old daughter where my daughter was out of control screaming and the mother tried to disipline her. there was people in the mall that thought the child was being beat so they called the police and C.A.S in. Children's aid society came in and took the child stating there was a risk of harm. They also wont release my daughter to me even though i have no record and been helping to raise a 6 year old son with an ex wife.C.A.S said they did not know me well enough for the child to be released to my care till the investigation is completed. My question is what can i do legally to get my daughter out of foster care and do i have a legal stand point to sue C.A.S in a lawsuit since the continue to over step there authority not thinking of the childs best interest but more that they have all this power.

What you need to do is retain an attorney. Once an agency like CPS or CAS get involved the only way forward is to drag them before a judge to justify their actions. Until then, they can abuse you and the situation all they want and they will ignore you in the process.
