CA - Daughter Got Her Nose Broken In School

What is the name of your state? I live in California. My daughter goes to a private school. Several weeks ago, she was playing with some kids and one of the kids pusher her of a chair where then she subsequently broke her nose. We had to take her to emergency room to get checked on. I took several pictures of her nose at the time it was broken as well as the area where the incident occurred. Furthermore, while the kids were playing, they were completely unattended. I understand that there is no point in suing the parents of the child that pushed my daughter; however, I'm interesting in finding out where there is a point in suing the school for negligence. Thus do I have a case? Please don't hesitate to ask me if you need any more details.What is the name of your state?

I am sorry to hear about your daughter.
The school may be liable for negligence in their reckless attendance to the children under their care and supervision.
For the school to be liable, the following four questions must be answered in the affirmative:
1. Did the school owe a duty to the plaintiff?
2. Did the school in breach of that duty?
3. Was the plaintiff injured?
4. Was the breach the proximate cause of the injuries?

I would suggest you speak to an attorney in your area in order to develop a potential liability case.

If there is liability, your son may be entitled to medical bill compensation regardless of insurance as well as pain and suffering and compensation for any permanent impairment.
